These Terms of Service ("Terms") govern your access to and use of POPS4 (the "Service," "app," or "POPS4"), a publishing and content distribution product operated by HAKO SHIKIN LLC ("POPS4," "we," "us," or "our"), and any related websites, software, APIs, and services we offer, including pops4.com and huanggoodman.com.
By accessing or using POPS4, you agree to be bound by these Terms. If you do not agree, do not use the Service.
POPS4 is a content publishing platform that creates short-form editorial video content about corporate branding, promotional products, and market intelligence. POPS4 publishes this content to third-party platforms including (but not limited to) YouTube, TikTok, Pinterest, X (formerly Twitter), LinkedIn, Instagram, and Substack. POPS4 also operates the Huang Goodman Market Intelligence editorial brief and related services.
You must be at least 13 years old to use POPS4. By using the Service, you represent and warrant that you meet this requirement and that you have the legal authority to agree to these Terms on behalf of yourself or any entity you represent.
Access to certain POPS4 features requires an account or a connection to a third-party platform via OAuth (including YouTube/Google, TikTok, Pinterest, X, LinkedIn, and Meta platforms). You are responsible for maintaining the security of your credentials and for any activity that occurs under your account. You agree not to share your credentials with unauthorized parties.

POPS4 may allow you to submit, upload, or otherwise make available content ("User Content"). You retain ownership of your User Content. By submitting User Content to POPS4, you grant POPS4 a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting), distribute, and display your User Content solely as necessary to provide the Service and distribute content to the third-party platforms you have authorized.
You represent and warrant that you have all rights necessary to grant this license and that your User Content does not violate any third-party rights or applicable law.
POPS4 interoperates with YouTube, TikTok, Pinterest, X, LinkedIn, Instagram, Meta platforms, Substack, and other third-party services. Your use of those services through POPS4 is also governed by the applicable third-party terms of service and privacy policies. POPS4 is not responsible for the availability, content, or practices of any third-party platform. When POPS4 uploads or publishes content on your behalf to a third-party platform, you authorize POPS4 to act on your behalf under the terms you have separately accepted with that platform.
POPS4 uses YouTube API Services. By using POPS4 you are also agreeing to be bound by the YouTube Terms of Service and the Google Privacy Policy. You may revoke POPS4's access to your Google account at any time by visiting the Google security settings page.
POPS4, the POPS4 name and logo, the Huang Goodman Market Intelligence name, and all related marks, software, and content (other than User Content) are the property of HAKO SHIKIN LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use any POPS4 marks without our prior written permission.
Some POPS4 features may be offered for a fee. If you subscribe to a paid POPS4 service, the specific fees and billing terms will be disclosed at the time of purchase. All fees are non-refundable except as required by law.
Promotional product orders. POPS4 sells branded, custom-imprinted, and promotional merchandise through pops4.com and related properties. For any purchase order of printed, decorated, or custom-manufactured promotional products, the terms, conditions, production tolerances, shipping, cancellation, rush charges, approvals, and return policies published at PRINTTERMSANDCONDITIONS.COM are incorporated into these Terms by reference and govern that order in addition to the terms set forth herein. Where a conflict exists between PRINTTERMSANDCONDITIONS.COM and these Terms with respect to a print product order, the PRINTTERMSANDCONDITIONS.COM terms control for that order. For all other POPS4 services (including the video publishing pipeline, editorial briefs, and third-party platform distribution described elsewhere in these Terms) these POPS4 Terms control.
We may suspend or terminate your access to POPS4 at any time, with or without notice, if you violate these Terms, if required by law, or if we discontinue the Service. You may stop using POPS4 at any time. Upon termination, sections 4 through 14 of these Terms will survive.
POPS4 IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT POPS4 WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT PUBLISHED THROUGH POPS4 WILL BE AVAILABLE ON ANY THIRD-PARTY PLATFORM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAKO SHIKIN LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF POPS4. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF POPS4 WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT YOU PAID TO POPS4 IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless HAKO SHIKIN LLC and POPS4 from and against any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising out of your use of POPS4, your User Content, or your violation of these Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Any dispute arising out of these Terms or your use of POPS4 will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on pops4.com and updating the "Effective" date above. Your continued use of POPS4 after the changes take effect constitutes your acceptance of the revised Terms.
