Prediction Markets Brace for $2B Industry Squeeze as Bipartisan Heat Builds Post-Midterms

Polymarket's election visibility created regulatory surface area neither party wanted to defend.

In plain words

Bipartisan scrutiny post-midterms puts **$570M** in election-volume platforms on regulatory collision course by Q1 2025.

$450M
in election volume over six weeks
$120M
in the same window
$18,000
shorting a local congressional race
$500
per NFL game

Prediction markets operators are staffing Washington affairs teams and retaining outside counsel after the midterm cycle made their platforms too visible for either party to ignore. Polymarket processed $450M in election volume over six weeks. Kalshi cleared $120M in the same window. Congressional staffers on both Finance and Agriculture committees are now asking basic questions about position limits and customer verification that suggest pre-legislative diligence.

The squeeze comes from opposite ends. Progressive senators object to what they see as unregulated sports-book infrastructure repackaged for political outcomes—gambling on democracy, in the talking points. Conservative members dislike platforms where wrong-side positions on their candidates created windfalls for coastal users. A House Financial Services staffer said his boss received constituent mail about a neighbor who made $18,000 shorting a local congressional race. The neighbor posted screenshots. The constituent wants to know why that is legal when his FanDuel account is capped at $500 per NFL game.

Polymarket's CFTC settlement in 2022 required the platform to block U.S. users and pay a $1.4M fine for operating without registration. Compliance is imperfect. VPN traffic from American IP addresses remains significant, according to blockchain analytics firms that track USDC flows. Kalshi obtained CFTC approval as a designated contract market but faces its own constraints—no state-level elections, no congressional races, strict event-contract language. The divergence in regulatory treatment creates arbitrage that makes neither regulators nor lawmakers comfortable.

Bipartisan pressure typically means agencies move. The CFTC has five commissioners and a $365M annual budget spread thin across derivatives markets worth trillions. Prediction markets represent a rounding error in notional volume but an outsize share of public attention. That attracts enforcement resources. Senate Agriculture, which oversees the CFTC, held a closed-door briefing in late October on event contracts. No transcript was released. A committee spokeswoman confirmed the briefing occurred and said "multiple stakeholders" attended.

Kalshi has spent $4.2M on lobbying since 2021, according to disclosure filings. The company hired Brownstein Hyatt, a firm with ties to both Senate leadership offices. Polymarket's U.S. lobbying spend is $0—the platform's posture remains offshore. That creates asymmetry in the coming fight. Kalshi can argue for a regulated path and cite its compliance costs. Polymarket's defense is harder to articulate in a hearing room.

Sponsor deals are already feeling the chill. A sportsbook operator in talks to integrate Kalshi's API into its app put the partnership on hold after its general counsel reviewed election-related TikTok clips showing teenagers explaining how to "fade Trump stock" on prediction platforms. The marketing risk outweighed the engagement upside. A second operator confirmed similar internal conversations. No one wants to explain to a state gaming regulator why their app linked to a platform where users trade contracts on congressional deaths or war outcomes.

The industry's bigger problem is definitional. Is a prediction market a derivatives exchange, a gaming operator, or a research tool? Kalshi pitches itself as a CFTC-regulated exchange offering hedging instruments. Polymarket calls itself an information market. PredictIt, which the CFTC attempted to shut down in 2022 before a court delay, describes itself as an academic research project operated by Victoria University of Wellington. When agencies cannot agree on taxonomy, they tend to restrict first and classify later.

What comes next depends on whether the CFTC moves unilaterally or waits for legislative clarity. Congressional calendars suggest a hearing in Q1 2025, likely in Senate Agriculture. The House Financial Services Committee may hold a parallel session. Kalshi will send its CEO. Polymarket's founder may not attend—testifying while blocking U.S. users creates optics problems. If the CFTC acts first, expect a policy statement narrowing the definition of permissible event contracts, possibly excluding all political outcomes. That would force Kalshi to pivot its product mix and effectively confirm Polymarket's offshore status.

Three governor's races, a Senate special election, and the 2024 presidential cycle sit ahead. Prediction markets will have liquidity. They will have users. Whether they have regulatory permission is the trade neither side wants to price.

Your next customer won't visit your website. Their AI will.
AI assistants have quietly taken over the first step of buying — they answer from catalogs they can read and shortlist whoever can actually ship. Two questions now decide whether you exist to that buyer: can a machine read your catalog, and can you fulfill the order. Most brands fail one or both and never find out why the orders went elsewhere. The winners of this shift aren't the loudest. They're the most readable. Build for the machine that's about to do the shopping.

Built by the craft floor — apparel, media, packaging, and secure print.
This trade runs on hands, not desks. Imprint manufacturing & Komori heritage press through approved vendors · Canon high-speed secure-media operations is a craft floor — genuine Six Sigma discipline applied to ink, thread, foil, and registration, where a hundredth of an inch is the difference between a brand that reads serious and one that reads cheap. POPS4 is built by exactly those operators: independent, boots-on-the-ground engineers who carry their own book, read a client in microseconds, and put their name on every run. Beyond our own Virginia Beach floor, we work with a vetted network of craft manufacturers across the US — each meeting the highest excellence in QC standards in the industry, each a specialist in its own discipline — so apparel, hard-goods imprinting, media manufacturing, packaging, and secure printing all go to the bench built for them, coordinated from one accountable hub.
